Staff Analysis of the Legislation

 This bill would amend Chapter 1 of Title 34 of the O.C.G.A. to prohibit an application question asking whether the applicant has ever been arrested for, charged with, or convicted of any crime with exceptions. However, it would allow such information to be sought during the first interview with the candidate. Exceptions to the application question would include:

1. Law enforcement agency positions or related to such positions;

2. Federal or state law or regulation that is a mandatory disqualification; or

3. If a standard fidelity bond or equivalent is required for the position being sought.
